    1. Introduction

Welcome to Kasbanah's app, owned by Kasbanah, 8 Ahmed El-Shedyak, Ard El Golf, Cairo, Egypt (“Kasbanah” or “we”).

The purpose of this platform is to offer a straightforward and user-friendly service to individuals, connecting them with local merchants for collection (referred to as "our Service") to order various items, including prepared meals, beverages, non-prepared food (collectively known as "Goods/Bag“). Kasbanah's mission is to combat food waste and reduce it in Egypt by facilitating the reservation of surplus food in “Bag” (“Products”) from various establishments such as food stores, restaurants, supermarkets, bakeries, etc. (“Stores”) presented on our platform (the “Service”). These terms and conditions (“Terms”) are applicable to any reservation and purchase of the Products executed through our websites or app (“Platform”). By placing a Reservation Order (as defined below), the Customer acknowledges and accepts these Terms. Therefore, it is imperative that the Customer thoroughly reviews the Terms before placing any order on the Platform.

    2. Kasbanah Concept

    Once a Customer reserves a Product, and the Store accepts the Reservation, the Customer commits to being present at the Store at the Pick-up time (as defined below). Simultaneously, the Store commits to offering the Products for sale, as specified herein. Both parties reserve the right of cancellation, as outlined below.
    Kasbanah acts solely as a facilitator for the sale of Products on the Platform on behalf of the Store. There exists no contractual relationship between Kasbanah and the Customer concerning the Products or the sale of Products. Kasbanah bears no responsibility for the Products or the fulfilment of the agreement between the Store and the Customer.
    Kasbanah solely collects the Purchase Price (as defined below) for the Products on behalf of the Store and functions solely as a payment agent on behalf of the Store.

    3. Acceptance

    By placing an order on the Platform, the Customer affirms: Legal capacity to enter binding agreements. Consumer status, shopping for personal use. Age of 18 or above, possessing a valid debit, credit card, or other payment method available on the Platform. Acceptance of these Terms implies the Customer's consent to receive all relevant information in English. Additionally, the Customer agrees to receive emails and text messages related to any orders placed. This is necessary to ensure the Customer receives essential notifications concerning their order. Kasbanah retains the right to revise and amend the Terms periodically. The Customer's order is subject to the Terms applicable at the time of placing the order.


  • 4. Product Information
Kasbanah is exclusively arranging the contract between the Customer and the Store, with no responsibilities for the Products or contract fulfilment. Kasbanah does not engage in manufacturing, selling, purchasing, storing, preparing, producing, processing, marking, packing, delivering, or handling the Products. Kasbanah holds no responsibility for the fulfilment of contractual obligations between the Customer and the Store concerning the Products. The Customer can find information about the Products on the Platform, and this information serves as a guide for evaluating selected Products before making a reservation. Kasbanah disclaims liability for any inaccuracies or unavailability of information. Customers should verify allergy warnings, dish contents, or any other menu information directly with the Store before ordering. The Store is responsible for providing accurate and up-to-date information about the Products. Upon Pick-up, the Store will provide the Customer with information on ingredients, allergens, and other labelling-related details about the Product. Products purchased through the Kasbanah Platform should be consumed immediately after Pick-up and/or as instructed by the Product Label or the Store. Kasbanah assumes no liability for Customers’ adverse reactions resulting from inconsistent consumption with labelling or information provided in these terms or directly by the Store. Kasbanah is not responsible for any failure or non-compliance regarding the Products, including manufacturing, sale, purchase, storage, preparation, production, processing, marking, delivery, quality, ingredients, allergens, or handling of the Products.
  • 5. Reservation Of Products

The list considers geographical criteria, and the Customer can filter results based on Product availability, Pick-up time, the nature of Products in “Bags” or as determined by Kasbanah. The listed Stores are active on the Platform. The supply of Products on the Platform is an invitation for the Customer to place a reservation. A Reservation Order by the Customer (“Reservation Order”) is an offer to the Store to purchase a Product. The Reservation Order is accepted by the Store upon Pick-up, making the reservation final and binding, subject to the limitations on cancellation rights as described in clause 7 below.

  • 6. Reservation Confirmation

Upon receiving the Reservation Order, Kasbanah initiates processing and sends the reservation to the relevant Store. Kasbanah notifies the Customer that the Reservation Order has been received (“Reservation Confirmation”) and is being processed. It is essential to note that a confirmation page on the Platform indicates receipt and processing of the reservation but does not imply acceptance by the Store. The Customer should save the Reservation Confirmation, containing details about the reservation. However, the Reservation Confirmation does not signify acceptance of the reservation but serves as confirmation of order receipt.

  • 7. Right Of Cancellation
Kasbanah's concept aims to minimize food waste; hence, if the Store lacks excess Products, the Store may cancel the Reservation Order until two hours before the agreed Pick-up time (as defined below). In such cases, the Customer receives a cancellation notification from Kasbanah or the Store through email, SMS, or a Platform notification, provided correct contact information and consent for receiving notifications are in place. Due to the perishable nature of the Products, the Customer can only cancel the Reservation Order up to two hours before the agreed Pick-up time. However, the Customer may cancel the Reservation Order until Pick-up if the cancellation is due to ingredients, allergens, or other labeling-related issues concerning the Product. The Customer communicates the decision to cancel to Kasbanah via the complaint link on the Platform. Cancellation outside the specified rights renders the Customer ineligible for a refund.
  • 8. Price

All prices are indicated in the local currency EGP, including applicable VAT, and may exclude online payment administration charges unless specified otherwise. Fees related to the order and payment are calculated and listed when placing the Reservation Order.

  • 9. Payment

Customers can pay using various debit and credit cards and other payment methods available on the Platform. For credit or debit card payments, the Customer provides card details when placing a Reservation Order. Upon placing a Reservation Order, the Purchase Price (as defined below) is authorized or reserved on the Customer's account. The Purchase Price is charged at the Customer's account upon Product reservation or immediately after Pick-up, depending on the chosen payment method. If the reservation is canceled in accordance with these Terms, the Purchase Price is canceled or refunded to the Customer. The Purchase Price is collected by Kasbanah from the Customer on behalf of the Store. Kasbanah may modify the payment procedure for its Customers as it deems reasonable. The Platform uses PCI compliant Payment Service Providers, ensuring secure credit or debit card transactions. Kasbanah does not store card information, which is handled by the Payment Service Providers. If the Customer's payment method is rejected, the Customer should verify the entered information. After correcting errors, if the card is still rejected, the Customer is advised to contact their bank. Once a Reservation Order is submitted and payment is authorized, the bank or card issuer reserves the full amount. If the Reservation Order is rejected or canceled, the bank or card issuer will refund the Customer, a process that may take up to 10 working days. By accepting these Terms, the Customer acknowledges the payment method described above and agrees that Kasbanah is not responsible for payment issues beyond its control.

  • 10. Governing Law

These Terms, including any reservation and purchase of Products, are subject to the laws of Egypt. Any dispute unresolved amicably shall be decided by the courts of Egypt. The Customer may also submit complaints to the relevant consumer protection authority in Egypt.
